The Court of Protection (Court) is a specialist court for all issues relating to people who lack capacity to make specific decisions. The Court makes decisions and appoints Deputies to make decisions in the best interests of those who lack capacity to do so.
The guidance booklet COP42 – Making an Application to the Court of Protection should be carefully read to determine if you need the Court to make a decision and also the type of decision you would like the Court to make.
Once you have read this guidance and you decide you do need the Court to make a certain decision then one or more of the following packs may be required. There are ten application packs.
- Application pack 1 - This pack is for those applications that relate to property and affairs only and you do not need permission to apply.
- Application pack 2 - This pack is for those applications that relate to property and affairs only and you need permission to apply.
- Application pack 3 - This pack is for those applications that relate to personal welfare only and you do not need permission to apply.
- Application pack 4 - This pack is for those applications that relate to personal welfare only and you need permission to apply.
- Application pack 5 - This pack is for those applications that relate to property and affairs and personal welfare and you do not need permission to apply.
- Application pack 6 - This pack is for those applications that relate to property and affairs and personal welfare and you need permission to apply.
- Application pack 7 - This pack is for those applications that relate to the registration of an Enduring Power of Attorney (to object to registration or apply for registration following a suspension).
- Application pack 8 - This pack is for those applications that relate to an objection (on prescribed grounds) to the registration of a Lasting Power of Attorney.
- Application pack 9 - This pack is for those applications that ask for a reconsideration of a Court decision.
- Application pack 10 - This pack is for those applications that relate to an appeal against a decision of the Court.
The packs are packaged as ZIP files. Most modern computer operating systems should allow you to open this type of file.
